These Terms of Service ("Terms") govern your access to and use of the website located at palmguards.com (the "Site") operated by PalmGuards Inc. ("PalmGuards," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Site, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you do not agree to any part of these Terms, do not access or use the Site.

2. Products and Orders

PalmGuards sells palm protection products ("Products"). All orders are subject to availability and our confirmation. We reserve the right to cancel or limit orders at our sole discretion, including but not limited to orders placed by resellers or in quantities exceeding normal retail purchase.

Prices are listed in CAD and are subject to change without notice. We make reasonable efforts to display accurate pricing; errors will be corrected and we may cancel affected orders.

3. Subscriptions

If you purchase a subscription, you agree to the recurring billing terms presented at checkout. Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings or by contacting us at support@palmguards.com.

4. Payment

Payments are processed securely through Stripe. By placing an order, you authorize us to charge the payment method you provide for the total order amount. If a payment fails, we may retry or cancel the order and you will be notified.

5. Shipping and Delivery

We make reasonable efforts to ship Products within 1–2 business days of order confirmation. Delivery timelines are estimates only and are not guaranteed. PalmGuards is not liable for delays beyond our control (e.g., carrier delays, customs, or force majeure events).

6. Returns and Refunds

All sales are final. Products are single-use items and for hygiene reasons cannot be returned once opened or used. If you receive a damaged or defective item, contact us within 14 days of delivery at support@palmguards.com with photos and your order number, and we will assess the situation on a case-by-case basis. Refunds, when issued, are processed to the original payment method within 5–10 business days.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of PalmGuards Inc. or its content suppliers and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. User Conduct

You agree not to use the Site for any unlawful purpose or in a way that violates these Terms. Prohibited uses include attempting to gain unauthorized access, interfering with the Site's operation, or using automated tools to scrape or extract data without permission.

9. Disclaimer of Warranties

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Your use of the Site is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PalmGuards Inc. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, REGARDLESS OF THE LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid us in the 30 days preceding the claim.

You agree to indemnify and hold PalmGuards Inc. and its officers, directors, and employees harmless from any claim or demand, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.
